What is insurance fraud?
Making false statements, producing documents or misrepresenting events to gain an unfair benefit from insurance is treated as fraud or misrepresentation. It harms all policyholders by pushing premiums up.
Legal basis
- The regulation on detecting, reporting, recording and combating fraudulent insurance practices (Official Gazette no. 27920, 30.04.2011); records are kept by SBM.
- Turkish Penal Code no. 5237: fraud committed to obtain insurance money is an aggravated form of fraud under Article 158, punishable by imprisonment and a judicial fine.
- Turkish Commercial Code no. 6102: duties of disclosure before the contract and of notification after a loss.
Consequences
- Reduced or no claim payment
- Withdrawal from the contract or additional premium where material facts were misstated
- Recovery of amounts paid without entitlement
- Recording of the case in SBM's fraud database
- Criminal prosecution
Examples
- Staged accidents or reporting accidents that never happened
- Naming a different driver than the one who actually drove
- Reporting damage that occurred before the policy started as if it were later
- Exaggerating losses, adding old damage or inflating invoices
- False declarations about vehicle use, address or health
- Fake theft reports or deliberately started fires
